Terms of Service

1. Acceptance of terms

By accessing lvlupbio.co (the "Site"), operated by LVL UP BIOTECH LLC ("LVL UP BIOTECH," "we," or "us"), or placing an order, you agree to these Terms of Service and to our Privacy Policy, Research Disclaimer, and Shipping & Returns policy, each incorporated into these terms by reference. If you do not agree, do not use the Site.

2. Eligibility & qualified researcher status

The Site and all products are offered exclusively to persons who are at least 21 years of age and who are qualified researchers, research institutions, or their authorized purchasing agents. By registering or ordering, you represent and warrant that you meet these requirements and that any information you provide is accurate and current.

3. Research use only

All products sold by LVL UP BIOTECH are intended solely for in-vitro laboratory research and development use. They are not drugs, foods, cosmetics, dietary supplements, or medical devices; they are not for human or animal consumption; and they are not intended to diagnose, treat, cure, or prevent any disease. You assume full responsibility for the safe handling, use, storage, and disposal of any product in compliance with all applicable laws and good laboratory practice.

4. Orders, pricing & payment

All orders are subject to acceptance and product availability. We reserve the right to refuse, limit, or cancel any order at our discretion, including where a product is mispriced, out of stock, or where we believe an order violates these terms. Prices are shown in U.S. dollars and may change without notice. We currently accept Zelle and cryptocurrency; use only the payment details displayed at checkout for your specific order. Because these payment methods are generally irreversible, confirmed payments are final, and any adjustments are handled as refunds or credits under Section 6.

5. Purity guarantee

Each production lot is independently tested and ships with a Certificate of Analysis (COA). We expressly guarantee that lots meet 99%+ purity as stated on their COA. If a vial you receive tests below the purity stated on its COA, or arrives damaged, we will replace it or issue a credit at no charge. To make a claim, email info@lvlupbio.co within 30 days of delivery with your order number and supporting documentation (for example, third-party test results or photos of the damage). This guarantee is the express and exclusive warranty we provide, and the free replacement or credit described here is your sole and exclusive remedy under it. Except for this express guarantee, products are provided as described in Section 8.

6. Returns, refunds & cancellations

Returns, refunds, damaged or incorrect shipments, and cancellations are governed by our Shipping & Returns policy, which forms part of these terms. Because these are research compounds, we generally cannot accept returns of opened or used product for safety and integrity reasons, except as provided under the purity guarantee in Section 5 or that policy.

7. Shipping, title & risk of loss

We prepare orders for shipment after payment has cleared and provide tracking where available. Title to, and risk of loss for, products pass to you upon our delivery of the products to the carrier. You are responsible for ensuring that products may lawfully be shipped to and received at your address, and LVL UP BIOTECH is not responsible for shipments seized, delayed, or refused due to local restrictions.

8. Product information & disclaimer of warranties

We work to describe products, strengths, and stock accurately, but we do not warrant that all descriptions or other content are complete, current, or error-free. Except for the express purity guarantee in Section 5, the Site and all products are provided "AS IS" and "AS AVAILABLE," and to the fullest extent permitted by law LVL UP BIOTECH disclaims all other warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No product is warranted or intended to be fit for any human, veterinary, therapeutic, or diagnostic purpose.

9. Compliance with laws

You are solely responsible for knowing and complying with all laws and regulations that apply to purchasing, importing, possessing, and using research compounds in your jurisdiction. You agree not to resell or redistribute products for any non-research purpose, and not to represent them as fit for human or veterinary use.

10. Accounts & termination

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend, restrict, or terminate your account or access to the Site at any time, with or without notice, if we believe you have violated these terms or applicable law, or to protect the Site, our other customers, or our business.

11. Intellectual property

The Site and its content — including the "LVL UP BIOTECH" name and logo, text, graphics, product imagery, and design — are owned by or licensed to LVL UP BIOTECH and protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from them without our prior written permission, except as necessary to browse the Site and use your account.

12. Electronic communications

By registering or ordering, you consent to receive communications from us electronically — including order confirmations, shipping updates, and account notices — and you agree that electronic communications satisfy any legal requirement that such communications be in writing. Any marketing emails will include an unsubscribe link, and you may opt out of non-transactional messages at any time.

13. Limitation of liability

To the fullest extent permitted by law, LVL UP BIOTECH and its affiliates, officers, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from the use or misuse of any product or of the Site, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim is limited to the amount you paid for the product giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless LVL UP BIOTECH and its affiliates, officers, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of products, your violation of these terms, or your violation of any law or the rights of a third party.

15. Governing law & jurisdiction

These terms, and any dispute arising out of or relating to them or the Site, are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to Section 16, the exclusive venue for any dispute not resolved by arbitration shall be the state and federal courts located in the State of Florida, and you consent to their personal jurisdiction.

16. Dispute resolution; arbitration & class-action waiver

Please read this section carefully — it affects your legal rights. Except for claims that qualify for small-claims court, any dispute arising out of or relating to these terms, the Site, or any product shall be resolved by final and binding individual arbitration, administered by a recognized arbitration provider under its consumer rules, rather than in court. You and LVL UP BIOTECH waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. If any part of this section is found unenforceable, the remainder shall continue to apply.

17. Changes to these terms

We may update these terms at any time. Material changes will be reflected by the "last updated" date above, and your continued use of the Site after changes are posted constitutes acceptance of the revised terms.

18. Miscellaneous

These terms, together with the policies incorporated by reference, are the entire agreement between you and LVL UP BIOTECH regarding the Site and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to an affiliate or successor. Neither party is liable for any failure or delay caused by events beyond its reasonable control.
